E. Russell  Nunnally
Biography

Russell Nunnally’s practice concentrates on commercial litigation, appeals and mediation, with a particular emphasis on complex litigation.  He has extensive experience defending securities and employment discrimination lawsuits, including class actions.  He was the chair of the defense steering committee in one of the largest toxic tort cases ever filed. Russell has defended a number of lawsuits for several multi-national companies, including Kaiser Aluminum and Chemical Corporation, Dresser Industries, DSC Communications Corporation (now Alcatel), Republic Health Corporation, HCA Corporation, Johns-Manville Sales Corporation, GTE Southwest Incorporated (now Verizon), Southland Corporation (now Seven-Eleven) and Fireman’s Fund Insurance Company.


Russell has more than 30 years’ experience in virtually all aspects of civil litigation.  Representative cases in which he served as lead counsel are set out below.

Representative Matters
  • Represented the winning side in a landmark United States Supreme Court case where the scope of class actions in employment cases was considerably narrowed.
  • Successfully represented a local telephone company in litigation against several Texas cities regarding pass through charges and municipal fees.
  • Responded to governmental subpoenas and other requests for data and has successfully prevented the investigations from expanding.
  • Represented hospitals in several administrative and disciplinary proceedings and has kept his clients from being sued successfully for antitrust and other violations.
  • Won a motion for judgment for the defense in a case involving $50 million in lender liability claims, including fraud, RICO, and breach of contract.
  • Successfully defended an antitrust case claiming Robinson-Patman Act violations and refusal to deal.
  • Defended a large number of asbestos cases and obtained very favorable settlements for his client; his client won a defense verdict in the only case he was unable to settle.
  • Served as a member of the Criminal Justice Panel for the Northern District of Texas and negotiated very favorable plea bargains for the people he was appointed to represent; his client was acquitted in the only case that went to trial.
