Wendy A. Duprey
Biography

Wendy Duprey handles appellate matters in both the Texas courts of appeals and the United States Court of Appeals for the Fifth Circuit. She also provides appellate support in the trial court by assisting with preservation of error, jury charges, and both pre- and post-trial motion practice.

In addition to her appellate work, Wendy is an experienced trial attorney practicing in state and federal courts and before various arbitration tribunals. Wendy represents clients in a variety of industries, including complex contract and commercial disputes, and securities litigation. She also handles intellectual property litigation including claims involving patent, copyright, and trademark infringement, misappropriation of trade secrets, and related claims. Wendy is experienced in obtaining and defending against temporary restraining orders and temporary injunctions. She also represents broker/dealers and investment advisors in federal and state courts and in arbitrations before FINRA (f/k/a NASD).

  • Argued before the Dallas Court of Appeals in an appeal challenging the adequacy of an expert report under Chapter 74 of the Texas Civil Practice and Remedies Code in a medical-negligence case.
  • Part of appellate team submitting briefing to the United States Court of Appeals for the Fifth Circuit overturning a $6 million judgment in a fraud and conspiracy case.
  • Opposed a petition for writ of mandamus filed in the Dallas Court of Appeals in a business dispute. The Court of Appeals denied the relator’s petition for writ of mandamus.
  • Obtained an injunction compelling a company’s terminated information-technology employee to return stolen intellectual property, including misappropriated domain names, and obtained summary judgment awarding damages and attorneys’ fees to the company.
  • Obtained summary judgment granting a structured settlement company entitlement to a $250,000 annuity payment that was in dispute with a competitor.
  • Obtained summary judgment dismissing negligence, breach of fiduciary duty, and breach of contract claims asserted against a bank.
  • Obtained a special appearance and dismissal of all claims on behalf of out-of-state law firms in a legal-malpractice action.
  • Obtained dismissal in federal district court of all claims asserted against a Texas county court judge, a Texas district attorney, and a Texas county.  The plaintiff sought $10 million in damages based on alleged constitutional violations and an alleged malicious prosecution.
  • Part of litigation team that obtained enforcement of a national corporation’s arbitration provision in a contract with a customer, causing the lawsuit alleging a data-security breach to be compelled to arbitration in New York where the case settled.
  • Part of trial team obtaining a jury verdict granting a homeowner’s declaratory judgment claim against a contractor and finding in favor of the homeowner’s defenses to alleged Prompt Payment Act violations in a construction dispute.
  • Part of litigation team obtaining a settlement for a company in a lawsuit brought by a large international competitor that previously employed several of the company’s key employees in a lawsuit alleging misappropriation of trade secrets and other confidential information.
  • Represented broker-dealer in a federal court appeal seeking to vacate a $440,000 FINRA arbitration award.
  • Represented national broker-dealers in FINRA arbitration proceedings defending against various types of investor complaints, including allegations of misrepresentation, suitability, churning, breach of contract, and breach of fiduciary duty.
