Tammy, who serves as chair of the Bell Nunnally Litigation Practice group, concentrates her practice on civil, commercial, labor and employment, nonsubscriber defense and tort defense litigation. She also provides advice and counsel to clients in the areas of litigation avoidance and management and workplace issues, including human resources and employee mobility issues.
Commercial and Civil Litigation
A skilled litigator, Tammy has served as lead counsel in numerous commercial bench and jury trials, as well as arbitrations and appeals. Her clients span businesses, individuals and governmental entities from a wide variety of industries, including telecommunications, manufacturing, insurance, health care, food products, oil and gas, SaaS, advertising, retail, food service, security services, trucking, construction, franchising, real estate, debt servicing and high technology.
Helping entities efficiently manage their litigation budgets, Tammy provides pre-litigation advisory services, allowing clients to position themselves effectively in the ultimate event of litigation, to determine whether to pursue litigation, and to create innovative solutions to business disputes that avoid litigation altogether. When litigation is unavoidable, or the preferred approach, she balances client goals and desired outcomes through effective matter staffing and the use of appropriate technologies and litigation support tools.
Tammy’s litigation experience includes cases involving commercial and contract disputes, real estate and landlord/tenant disputes, construction matters, misappropriation of trade secrets, defense of property damage and personal injury claims. She regularly seeks and obtains, or successfully defends against, claims for injunctive relief on behalf of her clients, including claims involving unfair competition, breaches of noncompete and confidentiality agreements, and misappropriation of trade secrets. In addition, she defends major utility companies in suits regarding right-of-way and easement issues and in tort and contract claims brought by customers and contractors.
Labor and Employment
In the labor and employment realm, Tammy defends companies in discrimination and retaliation cases, including before state and federal regulatory and administrative agencies. She has defended companies and public entities in employment discrimination claims involving sexual harassment, gender, sexual orientation, race, religion, national origin, pregnancy, age, disability and retaliation, including workers’ compensation claims and FMLA retaliation. She also defends companies against Fair Labor Standards Act (FLSA) claims and responds to EEOC charges.
Tammy assists in and conducts workplace investigations and defends companies who are not subscribers to the Texas Workers’ Compensation system against tort claims brought by employees. In addition, she regularly advises employers on HR-related issues, including development of employee handbooks and workplace policies.
Probate and Trust Litigation
Tammy represents fiduciaries in litigation in the probate courts involving trusts and estates, including will contests, motions for accounting, and suits to remove fiduciaries.
