The Evolution of Attorney-Client Privilege for In-House Counsel (Ethics)
This ethics presentation will discuss the evolution of the attorney-client privilege for in-house counsel and cover dual-purpose communications and the limits of the privilege for in-house attorneys, including tips and traps to avoid for the unwary. It will also include the In Re Grand Jury case that was poised to resolve a circuit split regarding dual-purpose communications and provide guidance to in-house legal departments across the U.S., but that was frustratingly dismissed by SCOTUS after certiorari was granted and oral arguments heard.

Imagining a World Without Noncompetes
On January 5, 2023, the Federal Trade Commission introduced a sweeping proposed rule that would impose a nationwide ban on noncompete agreements in all but a limited number of cases. In this session, we will explore the breadth and effect of the FTC’s proposed rule, the likelihood that it takes effect and survival tips for in-house counsel to gear up to protect crucial corporate assets, including goodwill and confidential information, in a world where noncompete agreements are off the table.
