This executive order concerns the removal of illegal aliens admitted to this country during the Biden administration. It revokes four executive orders issued by President Biden dealing with immigration and asylum. It calls for the enforcement of final orders of removal of aliens; prosecution of criminal offenses related to unauthorized entry or continued unauthorized presence in this country by aliens; removal of criminal cartels and gangs; unregistered aliens to register or to be prosecuted civilly or criminally for failure to do so; cooperation between state and local law-enforcement agencies with federal government to assist in the removal of illegal aliens; the discontinuance of granting of immigrant and non-immigrant visas to citizens and subjects of countries that refuse to repatriate their nationals who are subject to removal from the United States; and withholding federal funding to sanctuary jurisdictions that seek to interfere with the lawful exercise of federal law enforcement operations.
On April 24, 2025, a federal district judge enjoined enforcement of this executive order to the extent it withholds federal funding from the plaintiffs, which are 16 counties and cities in California, Washington, Minnesota and New Mexico. On Aug. 22, 2025, the court granted a second preliminary injunction that applies to an additional 34 counties and cities around the country.
This executive order has also been challenged in federal court in Massachusetts.
