This executive order undertakes to declare that a person born in the United States when the mother was unlawfully present in the United States or only temporarily in the United States, and whose father was not a United States citizen or lawful permanent resident at the time of the person’s birth is not a citizen of the United States.
This executive order was enjoined nationwide by three federal district courts. On June 27, 2025, the U.S. Supreme Court held that federal district courts lack the authority to issue nationwide injunctions and stayed enforcement of the lower courts’ injunctions only to the extent that the injunctions are broader than necessary to provide complete relief to each plaintiff with standing to sue.
The Supreme Court did not rule on the merits of the plaintiffs’ claims. Subsequent to the Supreme Court’s decision, federal district courts have certified the plaintiffs in their courts as a class and have issued nationwide injunctions to protect the class against enforcement of the order.
