The purpose of the order is to remove impediments to the development, production, investment and use of domestic energy resources, including oil, natural gas, coal, hydropower, geothermal, biofuel, and critical mineral and nuclear energy resources. The order is based on the premise that certain state practices threaten American energy dominance beyond their constitutional or statutory authorities, including laws that seek to impose fines on traditional energy producers for their purported past contributions to greenhouse gas emissions and policies adopting caps on the amount of carbon businesses may use. The order directs the attorney general to identify state and local laws and regulations that burden the development of American energy resources, and to take appropriate action to stop the enforcement of those laws, regulations and civil actions that the attorney general determines to be illegal under federal law.
