This executive order directs the EPA, the Department of Energy (DOE), the Federal Energy Regulatory Commission (FERC) and the Nuclear Regulatory Commission (NRC) to put sunset provisions in the existing and any new regulations governing energy production promulgated under the numerous laws listed in the order to the extent permitted by law. It directs those agencies to set a sunset rule by Sept. 30, 2025, and that each covered and existing regulation will have a conditional sunset date of one year after the effective date of the sunset rule. Any new regulation shall have a conditional sunset date that is not more than five years in the future. The sunset provisions will cause the agencies to periodically review their regulations. The executive order does provide that the agencies are to offer the public an opportunity to comment on the cost and benefits of each regulation prior to its expiration and that the agency can extend the sunset date if it finds such an extension is warranted.
