This executive order concerns the dependence of the United States on the importation of critical minerals (oxides, oxalates, salts and metals) and their derivatives that are foundational to military and energy infrastructure, advanced defense systems and technologies that are critical to a robust economy, defense and industrial base. It directs the secretary of commerce to (a) conduct an investigation under section 232 of the Trade Expansion Act of 1962 (allows investigations to determine the effect of specific imports on national security); (b) make a national risk assessment of the country’s reliance upon foreign suppliers for those minerals and their derivatives; (c) analyze the current potential capabilities of the United States to produce those minerals and their products; and (d) consider whether to make recommendations for the imposition of tariffs, as well as other import restrictions on those minerals and derivatives, and implementing policies to incentivize domestic production of them.
