The purpose of this executive order is to ban pay-for-play payments to college athletes and to increase collegiate athletic scholarships for women and non-revenue sports. It directs the secretary of education in consultation with the attorney general, the secretary of health and human services, the secretary of education and the chairman of the Federal Trade Commission to develop a plan to carry out the order through regulatory, enforcement and litigation mechanisms and federal funding decisions. The order does not include compensation provided to an athlete for the fair market value that the athlete provides to a third-party, such as brand endorsement.
If the federal government cuts off funding to colleges based on this executive order, litigation will probably ensue.
