In Executive Order 14195 President Trump imposed an ad valorem duty rate of 10% on articles that are products of the People’s Republic of China (PRC) because of the PRC’s failure to blunt the sustained influx of synthetic opioids, including fentanyl, into the United States. President Trump subsequently raised the ad valorem rate of duty to 20% in Executive Order 14228.
Executive order 14357 recites that the PRC has committed to take significant measures to end the flow of fentanyl into the United States. As a result Executive Order 14357 reduces ad valorem rate on PRC products to 10%. The secretary of homeland security is directed to continue to monitor the conditions with respect to opioids and fentanyl that caused the promulgation of Executive Order 14195.
