This executive order recites that the manufacture and distribution of fentanyl primarily through organized criminal networks threatens the national security of the United States; fuels lawlessness in the United States’ hemisphere and at its borders; and has a potential to be weaponized for concentrated, large scale terror attacks, thereby making it a threat to the United States. Therefore, the executive order (a) designates fentanyl as a weapon of mass destruction; and it directs the attorney general to pursue investigations and prosecutions of fentanyl trafficking; (b) directs the secretary of state and secretary of the treasury to pursue appropriate actions against relevant assets and financial institutions involved in the fentanyl trade; (c) instructs the secretary of war and the attorney general to determine whether the threats posed by illicit fentanyl warrant the provision of resources of the Department of War to the Department of Justice to aid in the enforcement of the United States criminal laws; (d) tells the secretary of war to update all directives regarding the Armed Forces’ response to chemical incidents in the homeland to include threat of illicit fentanyl; and (e) orders the secretary of homeland security to identify threat networks related to fentanyl smuggling.
