This executive order directs the attorney general to take the necessary steps to complete the rule making process related to scheduling marijuana from Schedule I to Schedule III of the Controlled Substances Act (CSA). The reasons for the order are findings by (1) the Food and Drug Administration that there is scientific support for the use of marijuana to treat anorexia related to a medical condition, nausea, vomiting and pain and (2) the Department of Health and Human Services’ recommendation to the Drug Enforcement Administration that marijuana be controlled under Schedule III of the CSA instead of under Section I in order to make it easier to conduct medical marijuana research to better inform patients and doctors of its uses, benefits and risks.
