This executive order recites that the government of Cuba is a totalitarian regime that has taken extraordinary actions that threaten the United States and has aligned itself with hostile countries, including Russia, the People’s Republic of China and Iran, as well as Hamas and Hezbollah. Consequently, this executive order imposes a tariff upon countries selling oil directly or indirectly to Cuba. Those tariffs are to be imposed pursuit to the International Emergency Economic Powers Act*. The secretary of commerce, in consultation with the secretary of state, shall determine whether a foreign country directly or indirectly sells or otherwise provides oil to Cuba; and the two secretaries will make recommendations as to the extent of an additional ad valorem rate of duty to be imposed on such countries. The president will make the final decision on the rates to be imposed.
*The U.S. Supreme Court has decided that the president does not have the power to impose tariffs pursuant to this act.
