This executive order imposes a tariff upon articles that are products of foreign countries that directly or indirectly purchase, import or otherwise acquire any goods or services from Iran. The tariffs are to be imposed to the International Emergency Economic Powers Act.* The secretary of commerce, in consultation, with the secretary of state, shall determine whether a foreign country directly or indirectly purchases, imports or otherwise acquires any goods or services from Iran. After such a determination is made, the secretary of state will recommend an additional ad valorem rate of duty to be imposed on such countries; and the president will make the decision on the rates to be imposed based upon such recommendation.
* The U.S. Supreme Court has decided that the president does not have the power to impose tariffs pursuant to this act.
