This order references the June 30, 2026, U.S. Supreme Court decision that held that the United States Constitution extends the privilege of citizenship to children born to parents in the United States and identified certain categories of children of aliens who do not fall within the rule of birthright citizenship. The executive order recites categories of persons born in the United States who will not be recognized by the United States as citizens of the country. They include children born to (a) a parent or parents of an alien enemy; (b) foreign government employees, including ambassadors; (c) persons employed by foreign embassies or nationals of that foreign country; (d) persons employed by foreign governments in an official capacity; (e) persons employed by an international organization that possesses international organization immunity; and (f) persons engaged in a commercial transaction to purchase or access birthright citizenship for the person or engaged in fraudulent activity to obtain citizenship.
