This executive order recites that birth tourism operators use deceptive advertisements and inducements to entice foreign nationals to travel to the United States for the purpose of giving birth on American soil and that participants in birth tourism schemes abuse the immigration laws of the United States to secure the advantage of citizenship for their children and then potentially for themselves. The order directs the secretary of state and the secretary of homeland security to take appropriate action to (a) prevent the entry into the United States of, or the granting of any visa or other travel authorization to, any alien entering or attempting to enter the country for the purpose of engaging in birth tourism; (b) revoke the visa or other travel authorization of, and permanently bar the entry of, any alien who enters or attempts to enter the United States for the purpose of engaging in birth tourism; (c) deny entry to, or remove, any alien who previously engaged or plans to engage in birth tourism; and (d) take other appropriate action against entities, organizations or individuals responsible for facilitating or enabling birth tourism. The order gives the secretaries discretion to exempt foreign nationals from actions taken pursuant to this executive order on humanitarian grounds or where the foreign national’s entry into the United States is in the national interest.
