This executive order recites that the restricted global diesel supply has led to rising prices. Therefore, it directs the secretary of the treasury to (a) defer certain diesel fuel tax payment obligations and to provide penalty relief to the extent permitted by law to help provide financial relief to American farmers, truckers and workers; (b) determine whether there are grounds for postponement of the federal tax on diesel fuels and to defer those payments from Oct. 5 to Dec. 31, 2026, with no penalties, interest or other amounts in addition to the tax; (c) direct the IRS to announce it will not assess penalties when dyed diesel fuel was sold or used on the highway from Oct. 5 to Dec. 31, 2026; and (d) establish guidance for implementing the order, including the specific relief granted, the legal basis for the relief, covered taxpayers, liabilities and deadlines. The order also directs the secretary of agriculture to promote diesel fuel access for farmers and to ensure adequate distribution of diesel fuel for their use in high-demand areas and to encourage corresponding state action to further the policies of the executive order.
