The Constitutional Gamble: How Murphy v. NCAA Rewrote America’s Sports Betting Landscape

Overview:

Partners Joshua Fuller and Danica Mathes are presenting a CLE program for the Dallas Bar Association’s Entertainment, Art & Sports Law Section titled, “The Constitutional Gamble: How Murphy v. NCAA Rewrote America’s Sports Betting Landscape.”

Date/Location:

Wednesday, May 27, 2026
12:00 p.m. CT

Arts District Mansion
Dallas, Texas

Event Details:

The first portion of the presentation will examine the 2018 U.S. Supreme Court decision in Murphy v. NCAA, which gave states the authority to legalize sports betting at the state level by overturning prior federal restrictions under the Professional and Amateur Sports Protection Act of 1992. The discussion will focus on the Tenth Amendment’s anti-commandeering doctrine and its impact on states’ rights to regulate gambling.

The second portion will explore the rapid growth of sports betting following Murphy and how companies have invested heavily in advertising, promotions and marketing as more states legalize sports gambling. Attendees will gain insight into the prevalence of advertisements from FanDuel and DraftKings, what these promotions entail and how to interpret the fine print.

The presentation will offer one hour of CLE credit.
