Partner Mark A. Shoffner is quoted in The Texas Lawbook / Dallas Business Journal article titled, “Wage & Hour Litigation Practice Remains Strong in Texas.” The piece examines the sustained increase in wage and hour litigation and notes that the number of FLSA lawsuits filed in Texas is now more than 900 per year. Shoffner stated that “even in the face of a good economy, these lawsuits will continue to be filed because perfect compliance with the wage and hour laws is difficult for employers, and it is easy to make a minor mistake that has major consequences.” He noted that FLSA cases are expensive to defend because they are often brought as class or collective actions and attorneys’ fee are recoverable for successful plaintiffs. Finally, Shoffner added that he expects FLSA cases to continue to be filed in near-record numbers because “plaintiffs’ lawyers are entrepreneurial and filing these cases in volume has proven to be a sustainable business model.”
